These Terms of Service (“Terms”) govern your access to and use of the LungDeep website, products, and services. By accessing our website or purchasing any product from LungDeep, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our website or purchase our products.

Throughout these Terms, “LungDeep”, “we”, “our”, and “us” refer to the owner and operator of the LungDeep online store.

Actual colors, finishes, packaging, and accessories may vary slightly.

We reserve the right to improve, modify, or discontinue products without prior notice.


3. PRODUCT SAFETY

Our products are intended solely for recreational use by responsible adults.

Improper use may result in serious injury or death.

Customers acknowledge that:

  • Diving always involves inherent risks.
  • Proper training is recommended before using any diving equipment.
  • Users are responsible for inspecting equipment before every use.
  • Damaged equipment must never be used.
  • LungDeep products must never be modified.
  • Only compatible accessories and replacement parts should be used.

Users assume all responsibility for ensuring safe operation of the equipment.


4. MEDICAL FITNESS

Customers are responsible for determining whether they are medically fit to use diving equipment.

Do not use LungDeep products if you suffer from medical conditions that may affect breathing, consciousness, cardiovascular function, or your ability to safely participate in underwater activities unless cleared by a qualified physician.


5. AGE REQUIREMENTS

Our products are intended for adults.

Persons under the age of 18 should only use LungDeep equipment under direct supervision of a qualified adult who assumes full responsibility for the minor.


6. ACCURACY OF INFORMATION

We strive to ensure that all information on our website is accurate.

However, occasional errors may occur, including but not limited to:

  • product descriptions
  • specifications
  • availability
  • shipping estimates
  • images

We reserve the right to correct errors without prior notice, including after an order has been placed.

If an obvious pricing error has occurred, we may cancel the order and issue a full refund.


7. ORDERS

Submitting an order does not automatically create a binding contract.

Your order becomes accepted only after:

  • stock availability has been confirmed;

8. PRICES

Unless otherwise stated:

  • Prices are displayed in Euros (€).
  • Prices include VAT where legally required.
  • Shipping costs are calculated separately during checkout.
  • Import duties, customs fees, and local taxes outside the European Union remain the customer’s responsibility.

Prices may change at any time without prior notice.

Price changes do not affect confirmed orders.


9. PAYMENT

We accept payment methods displayed during checkout.

LungDeep does not store complete payment card information.

10. SHIPPING

We currently ship to most countries worldwide.

Estimated delivery times are provided for guidance only and are not guaranteed.

Delivery delays may occur due to:

  • customs inspections;
  • weather conditions;
  • carrier delays;
  • public holidays;
  • force majeure events.

Risk of loss transfers to the customer once the goods have been delivered to the shipping address provided during checkout.

Customers are responsible for providing accurate delivery information.

Additional shipping costs resulting from incorrect addresses may be charged to the customer.


11. RIGHT OF WITHDRAWAL (EU CONSUMERS)

If you are a consumer residing in the European Union, you generally have the legal right to withdraw from your purchase within 14 calendar days without providing any reason, in accordance with applicable consumer protection laws.

To exercise this right, you must notify LungDeep within the withdrawal period.

Returned products must:

  • be unused;
  • be in their original condition;
  • include original packaging;
  • include all accessories;
  • include proof of purchase.

Refunds will be processed after the returned products have been inspected.

Certain products may not qualify for withdrawal where permitted by applicable law, including sealed items that have been unsealed after delivery for health or hygiene reasons.

12. CUSTOMER RESPONSIBILITIES

Customers agree to:

  • maintain equipment properly;
  • inspect products before every use;
  • never exceed recommended operating limits;

  • refrain from any misuse of LungDeep products.

Failure to follow these responsibilities may void warranties and limit available remedies under applicable law.

 

13. WARRANTY

LungDeep provides the statutory legal guarantee required under applicable consumer protection laws.

For consumers residing within the European Union, products are covered by the legal guarantee of conformity as provided under Directive (EU) 2019/771 and applicable national legislation.

This legal guarantee applies in addition to any voluntary commercial warranty that LungDeep may choose to offer.

The legal guarantee does not cover:

  • Normal wear and tear;
  • Cosmetic damage that does not affect functionality;
  • Damage caused by accidents;
  • Damage caused by misuse or abuse;
  • Damage resulting from improper maintenance;
  • Unauthorized repairs or modifications;
  • Improper storage;
  • Corrosion caused by improper cleaning or storage;
  • Damage caused by saltwater residue due to insufficient rinsing after use.

Customers must notify LungDeep of any lack of conformity within the period required by applicable law.


14. COMMERCIAL WARRANTY

Where applicable, LungDeep may offer a separate commercial warranty.

The commercial warranty does not replace, limit, or reduce the statutory rights available to consumers under applicable law.

Specific warranty periods, conditions, and exclusions are described on the relevant product pages or warranty documentation.


15. RETURNS

Returns must comply with our Refund Policy.

Returned products must:

  • Be clean;
  • Be completely dry;
  • Be safely packaged;
  • Include all supplied accessories;
  • Include manuals where applicable;
  • Include the original packaging whenever reasonably possible.

Products showing evidence of misuse, intentional damage, or unauthorized modifications may not qualify for a refund where permitted by law.

Customers are responsible for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.


16. REFUNDS

Once returned products have been received and inspected, LungDeep will notify the customer of the outcome.

Approved refunds will be issued using the original payment method unless otherwise agreed.

Refund processing times may vary depending on the payment provider.

Shipping charges are refundable only where required under applicable law.


17. PRODUCT USE DISCLAIMER

LungDeep products are designed for recreational underwater activities.

Customers acknowledge that:

  • Diving involves inherent risks;
  • Proper instruction and training are strongly recommended;
  • Users are responsible for evaluating environmental conditions before each dive;
  • LungDeep cannot supervise how products are used after delivery.

Users assume full responsibility for all risks associated with the use of the products.


18. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where such exclusion is prohibited by applicable law.

To the maximum extent permitted by law, LungDeep shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:
